He advised that he was in the back seat of the vehicle while accused ABBOTT was driving home on 10105/03. He explained that he seen victim HARTY remove the car keys from the ignition while accused ABBOTT was driving. He related that accused ABBOTT and victim HARTY began to fight over the keys. While they were fighting over the keys the vehicle traveled into the oncoming traffic lane. Witness WINDHORST advised that he did not see accused ABBOTT strike victim HARTY in the vehicle. He advised that once they arrived at their house that witness WEAVER who was sitting in the back seat went home. He explained that accused ABBOTT, victim HARTY, and he went into the house. He advised that he was sitting on his living room couch while accused ABBOTT and victim HARTY were in the kitchen. He explained that his back was towards them, and he just heard hi: mother hit the ground. He related that he then when out side, and the police came.
