Rueter, to which no objections have been filed,1 it is ORDERED: 1. The Report and Recommendation is APPROVED and ADOPTED; 2. The petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 is DENIED; 3. Dowdy’s request for an evidentiary hearing is DENIED; and 4.
