For the foregoing reasons, Defendants' Motion to Dismiss for failure to state a claim is DENIED with respect to Plaintiffs' claims of direct and contributory infringement against JIL for infringement of the WGI and IOD co pyrighted works; DENIED as to Plaintiffs' claims of direct infringement against Jefferies for infringement of the WGI and IOD copyrighted works; and GRANTED with respect to the claim against Jefferies for infringement of the OD newsletter. The O D claim is DISMISSED without prejudice pursuant to Rule 8(a) of the Federal Rules of Civil Procedure.
