Accordingly, IT IS HEREBY ORDERED THAT Defendant's motion for summary judgment is DENIED as to Plaintiff& #039;s claims for false arrest as against Park and UC and GRANTED as to Plaintiff's claims for malicious prosecution under § 1983 and New York State law. IT IS FURTHER ORDERED THAT Plaintiff's claims against Rivera and against all Defendants for First Amendment retaliation are DISMISSED.
