Treece, United States Magistrate Judge, advised by ReportRecommendation that defendants' motion pursuant to Federal Rules of Civil Procedure 37(b) and 41(b) be granted and that plaintiff's complaint be dismissed. No objections to the Report-Recommendation were filed.1 Based upon a careful review of the entire file and the recommendations of the Magistrate Judge, the Report-Recommendation is accepted in whole. See 28 U.S.C. § 636(b)(1). Therefore it is ORDERED that 1. Defendant's motion pursuant to Federal Rules of Civil Procedure 37(b) and 41(b) is GRANTED; 2. Plaintiff's complaint is DISMISSED in its entirely; and 3. The Clerk is directed to enter judgment accordingly and close the file. The Clerk is directed to serve a copy of this Decision and Order on the parties in accordance with the Local Rules.
