ORDER ON INFORMAL APPLICATION This matter having come before the Court for a telephone conference on March 30, 2006, regarding the status of this case, which was transferred from the Northern District of California on or about March 17, 2006; and the Court having been advised that it is related to Civil No. 054048(JLL); and the parties having further advised the Court that they intend to dismiss without prejudice Civil No. 06-1292(FSH) and that there would be no opposition to allowing the defendant in Civil No. 05-4048 to amend its counterclaim to include allegations embodied in the Complaint filed in Civil No. 06-1292; and the parties having further advised the Court that they are prepared to submit an Order to the Hon. Faith S. Hochberg reflecting this dismissal; and for good cause shown, IT IS on this 30th day of March, 2006 ORDERED that, no later than April 14, 2006, the parties shall submit a proposed dismissal order to the Hon.
