On March 17, 2010, the Honorable Peggy A. Leen, United States Magistrate Judge, entered a Report of Findings and Recommendation (Doc. #3) recommending that Plaintiff's Complaint (Doc. #1) be denied. Plaintiff Robinson was given notice to file a written objection with the court to Magistrate Judge Leen's Report and Recommendations within ten (10) days after being served. To date no objections have been filed and the time to do so has now expired. The Court has conducted a de novo review of the record in this case in accordance with 28 U.S.C.§ 636(b)(1) and Local Rule IB 3-2(a) and determines that Magistrate Judge Leen's Report of Findings and Recommendation should be Affirmed. /// 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 IT IS THEREFORE ORDERED that Magistrate Judge Leen's Report of Findings and Recommendation (Doc. #3) is Affirmed and Plaintiff James Robinson's Complaint (Doc. #1) is DISMISSED without prejudice.
