On November 5, 2010, Plaintiff filed a Complaint seeking to foreclose a mortgage held by Defendants. In its instant Motion, Plaintiff states that the mortgage held by Janet Stokke was released on November 8, 2010. Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A), a plaintiff may dismiss a defendant by filing a notice of dismissal before the opposing party serves an answer or a motion for summary judgment.
