Brimmer entered on February 25, 2013 it is ORDERED that the State’s Rule 12(b)(1) and Rule 12(b)(6) Motion to Dismiss Plaintiffs’ First Amended Complaint [Docket No. 29] is GRANTED. It is further ORDERED that Plaintiffs recover nothing, and that the action is dismissed. It is FURTHER ORDERED that the Defendants are AWARDED their costs, to be taxed by the Clerk of the Court pursuant to Fed. R. Civ. P. 54(d)(1) and D.C.COLO.LCivR 54.1.
