No. CV11-04569 LHK STIPULATION AND [PROPOSED] ORDER TO CONTINUE DEADLINE TO COMPLETE EARLY NEUTRAL EVALUATION COUNTY OF SANTA CLARA, DAN PEDDYCORD, RAE WEDEL, MARTY 16 FENSTERSHEIB AND DOES 1 THROUGH 50 INCLUSIVE, 15 17 Defendants. 18 19 The parties in the above-captioned case and the appointed evaluator submit this stipulation to 20 continue the deadline to complete the Early Neutral Evaluation. The requested extension is based on 21 the following grounds. 22 On May 9, 2012, the Court held an initial case management conference, after which the case 23 was referred to an Early Neutral Evaluation (ENE). On May 16, 2012, the court appointed an 24 evaluator, Thomas Gosselin. Pursuant to ADR Local Rule 5-4(b), the deadline to complete the ENE 25 is currently August 7, 2012. 26 On June 5, 2012, the parties and the appointed evaluator agreed to an ENE session on July 27 17, 2012. On July 16, 2012, however, Plaintiffs’ counsel indicated that the ENE would have to be 28 rescheduled because they were in a trial that began on that date in the Superior Court of the State of 1 Stipulation and [Proposed] Order to Continue Deadline to Complete ENE CV11-04569 LHK Case5:11-cv-04569-LHK Document21 Filed07/27/12 Page2 of 3 1 2 3 4 5 California for the County of Sacramento. The appointed evaluator has indicated that he has scheduling conflicts between now and August 7, 2012, and requested the parties to prepare a stipulation to extend the ENE deadline.
