Arafat Doc. 27 1 2 3 4 5 6 7 8 9 UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA OAKLAND DIVISION 10 11 13 DISH NETWORK L.L.C., ECHOSTAR TECHNOLOGIES L.L.C., and NAGRASTAR LLC, 14 Plaintiffs, 12 15 Case No. 3:11-cv-04447-YGR [PROPOSED] AGREED FINAL JUDGMENT AND PERMANENT INJUNCTION v. 16 MOHAMMED ARAFAT, 17 Defendant. 18 19 20 21 Having considered the parties’ Stipulation for Entry of Agreed Final Judgment and 22 Permanent Injunction, the court file in this matter, and the applicable law, the Court approves the 23 stipulation and ORDERS as follows: 24 25 26 (1) Defendant Mohammed Arafat, and any other person acting in active concert or participation with Defendant, is hereby permanently enjoined from: A. circumventing or assisting others in circumventing DISH Network’s 27 security system, or otherwise intercepting or assisting others in intercepting DISH Network’s 28 satellite signal; Agreed Final Judgment and Permanent Injunction Case No. 3:11-cv-04447-YGR Dockets.Justia.com 1 B. testing, analyzing, reverse engineering, manipulating, or otherwise 2 extracting codes, data, or information from DISH Network’s satellite receivers, smart cards, 3 satellite data stream, or any other part or component of the DISH Network security system. 4 (2) This permanent injunction takes effect immediately. 5 (3) Judgment is entered for DISH Network on Count I of the complaint alleging 6 violations of the Digital Millennium Copyright Act, 17 U.S.C. § 1201(a)(1), Count II alleging 7 violations of the Federal Communications Act, 47 U.S.C. § 605(a), and Count III alleging 8 violations of the Electronic Communications Privacy Act, 18 U.S.C. §§ 2511(1)(a) and 2520. 9 10 (4) Statutory damages in the amount of $10,000 are awarded to DISH Network in accordance with 18 U.S.C. § 2520(c)(2)(B). 11 (5) Each party is to bear its own attorney’s fees and costs. 12 (6) The Court retains jurisdiction over this action for a period of two years for the 13 purpose of enforcing this final judgment and permanent injunction. 14 PURSUANT TO STIPULATION, IT IS SO ORDERED. 15 16 Dated: April 12, 2012 17 18 19 Hon.
