No. C 12-02618 RS CASE MANAGEMENT SCHEDULING ORDER UNITED STATES OF AMERICA, Defendant. ____________________________________/ Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a Case 15 Management Conference on August 30, 2012. After considering the Joint Case Management 16 Statement submitted by the parties and consulting with the attorneys of record for the parties and 17 good cause appearing, IT IS HEREBY ORDERED THAT: 18 1. 19 MEDIATION. This matter is referred to mediation to be completed within 120 days of the ALTERNATIVE DISPUTE RESOLUTION. 20 issuance of this order. The parties shall promptly notify the Court whether the case is resolved at 21 the mediation. 22 2. DISCOVERY. On or before February 28, 2013, all non-expert discovery shall be 23 completed by the parties. Discovery shall be limited as follows: (a) ten (10) non-expert depositions 24 per party; (b) thirty-five (35) interrogatories per party, including all discrete subparts; (c) a 25 reasonable number of requests for production of documents or for inspection per party; and (d) a 26 reasonable number of requests for admission per party. 27 28 3. On or before April 12, 2013, plaintiff shall disclose expert testimony reports in accordance with Federal Rule of Civil Procedure 26(a)(2). B. On or before April 26, 2013, defendant shall disclose expert testimony and reports in accordance with Federal Rule of Civil Procedure 26(a)(2). C. On or before June 28, 2013, all discovery of expert witnesses pursuant to Federal Rule of Civil Procedure 26(b)(4) shall be completed. 4. FURTHER CASE MANAGEMENT CONFERENCE. A Further Case Management 8 Conference shall be held on March 14, 2013 at 10:00 a.m. in Courtroom 3, 17th Floor, United 9 States Courthouse, 450 Golden Gate Avenue, San Francisco, California. The parties shall file a 11 For the Northern District of California United States District Court 10 12 13 Joint Case Management Statement at least one week prior to the Conference. 5. PRETRIAL MOTIONS. All pretrial motions must be filed and served pursuant to Civil Local Rule 7. All pretrial motions shall be heard no later than September 12, 2013. 6. PRETRIAL STATEMENTS. At a time convenient to both, counsel shall meet and 14 confer to discuss preparation of a joint pretrial statement, and on or before December 5, 2013, 15 counsel shall file a Joint Pretrial Statement. 16 7. PRETRIAL CONFERENCE. The final pretrial conference will be held on 17 December 19, 2013 at 10:00 a.m., in Courtroom 3, 17th Floor, United States Courthouse, 450 18 Golden Gate Avenue, San Francisco, California. Each party or lead counsel who will try the case 19 shall attend personally. 20 8. TRIAL DATE. Trial shall commence on January 13, 2014 at 9:00 a.m., in 21 Courtroom 3, 17th Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, 22 California. 23 24 IT IS SO ORDERED.
