Pursuant to FRCP 41(a)(2), Defendant CHART 5 INTERNATIONAL, INC., (“Chart”) by and through its attorneys of record, represents Chart’s non- 6 objection to Plaintiff’s request to dismiss his case with prejudice, and thus Chart hereby stipulates to the 7 same.
