The Choice Warranty, Inc. (“Choice”) (Dkt. No. 90); WHEREAS, on July 2, 2012, Choice filed a motion to set aside the entry of default that 4 was set for hearing on August 10, 2012 (Dkt. No. 92); 5 6 7 WHEREAS, on July 24 2012, the Court issued an Order Granting Defendants’ Motions to Dismiss (Dkt. Nos. 65, 67) with leave to amend (Dkt. No. 105); 8 WHEREAS, on July 24, 2012, the Court also set a Case Management Conference for 9 August 10, 2012 at 9:00 a.m. and a Joint Case Management Conference Statement to be filed on 10 11 August 3, 2012; WHEREAS, the parties have been engaged in settlement negotiations and desire to 12 13 14 15 continue to explore and discuss resolution of this matter prior to expending further resources; WHEREAS, plaintiffs have agreed to withdraw their opposition to Choice’s motion to set aside entry of default; 16 NOW, THEREFORE, IT IS HEREBY STIPULATED by and between plaintiffs, 17 MEPCO Finance Corporation, Independent Bank Corporation, The Choice Manufacturing 18 Company, Inc. and Peter Masi through their respective counsel and subject to the Court’s 19 approval that: 20 21 1. The Case Management Conference currently scheduled on August 10, 2012 at 22 9:00 a.m. to be continued to September 14, 2012 or an alternative date that the Court determines 23 suitable; 24 25 26 2. No Joint Case Management Statement is currently due. The parties will file a Joint Case Management Statement seven days before the continued Case Management Conference date; and 27 3. 28 The hearing on Choice’s motion to set aside entry of default is vacated.
