On October 29, 2012, plaintiff was 17 directed to pay the appropriate filing fee and to show cause why this action should not be 18 dismissed for lack of subject matter jurisdiction. Plaintiff has not submitted the appropriate 19 filing fee and has further failed to respond to the court order. 20 Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed. 21 These findings and recommendations are submitted to the United States District 22 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1). Within fourteen 23 days after being served with these findings and recommendations, any party may file written 24 objections with the court and serve a copy on all parties.
