ORDER AND FINDINGS AND RECOMMENDATIONS 16 17 18 / Plaintiff is a state prisoner proceeding pro se with a civil rights action filed 19 pursuant to 42 U.S.C. § 1983. On October 17, 2012, plaintiff was instructed to file a complete 20 application to proceed in forma pauperis after it was determined that plaintiff’s previous 21 application was missing a completed certificate as well as a certified copy of his prison trust 22 account statement for the six-month period immediately preceding the filing of the complaint. 23 Plaintiff was given thirty days to file a complete application to proceed in forma pauperis along 24 with a certified copy of his prison trust account statement for the six-month period immediately 25 preceding the filing of the complaint. Thus, it will be recommended that this action be dismissed without 3 prejudice. Accordingly, IT IS HEREBY ORDERED that the Clerk of Court randomly assign 4 5 a United States District Judge to this action. Furthermore, IT IS HEREBY RECOMMENDED that this action be dismissed 6 7 without prejudice. These findings and recommendations are submitted to the United States District 8 9 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen 10 days after being served with these findings and recommendations, plaintiff may file written 11 objections with the court. The document should be captioned “Objections to Magistrate Judge’s 12 Findings and Recommendations.” Plaintiff is advised that failure to file objections within the 13 specified time may waive the right to appeal the District Court’s order.
