FINDINGS AND RECOMMENDATIONS / 15 On May 31, 2012, the court ordered petitioner to file an in forma pauperis 16 17 affidavit or pay the required filing fee within thirty days. The court cautioned petitioner that 18 failure to do so would result in the dismissal of this action. The thirty day period has now 19 expired, and petitioner has not responded to the court’s order. Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to 20 21 randomly assign a United States District Judge to this action. IT IS HEREBY RECOMMENDED that this action be dismissed without 22 23 24 prejudice. These findings and recommendations are submitted to the United States District 25 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
