RAYA, Petitioner, 10 vs. 11 12 No. CIV S-11-2557 WBS EFB P RONALD GROUNDS, Respondent. 13 ORDER / 14 Petitioner is a state prisoner without counsel seeking a writ of habeas corpus. See 28 15 16 U.S.C. § 2254. He has requested that the court appoint counsel. He also requests an extension 17 of time to file objections to the October 20, 2011 findings and recommendations. 18 There currently exists no absolute right to appointment of counsel in habeas proceedings. 19 See Nevius v. Sumner, 105 F.3d 453, 460 (9th Cir. 1996). The court may appoint counsel at any 20 stage of the proceedings “if the interests of justice so require.” See 18 U.S.C. § 3006A; see also, 21 Rule 8(c), Rules Governing Section 2254 Cases. The court does not find that the interests of 22 justice would be served by the appointment of counsel at this stage of the proceedings. 23 Accordingly, it hereby is ORDERED: 24 1. Petitioner’s October 31, 2011, request for appointment of counsel is denied without 25 prejudice. 26 //// 1 1 2.
