Plaintiff and Defendants Free Agents Entertainment, LLC and

Deon Taylor filed a Joint Status Report (“JSR”) on May 27, 2011, in
17
which they state:
The parties have reached an agreement in principle
to settle this matter in its entirety. The parties
expect to execute a written settlement agreement
and then request the dismissal of the entire
action, with prejudice, by no later than July 11,
2011. Accordingly, the parties respectfully request
that the pretrial scheduling conference currently
set for June 13, 2011, be continued until a date
after July 11, 2011.

Therefore, a dispositional document shall be filed no later

than July 11, 2011. Failure to respond by this deadline may be construed

as

include an explanation concerning how he is prosecuting this action

against Defendant Hooks and Taylor Entertainment, LLC, and why this

action should not be dismissed against this named defendant because of

failure of prosecution.

The status conference will remain on calendar, because the
mere representation that a case has been settled does not justify
vacating a scheduling proceeding. Cf. Callie v. Near, 829 F.2d 888, 890
(9th Cir. 1987)(indicating that a representation that claims have been
settled does not necessarily establish the existence of a binding
settlement agreement).
