(Dkt. No. 14.) The court gave plaintiff the option of 20 proceeding on his amended complaint or filing a second amended complaint that added a 21 cognizable claim against defendant McDonald. Plaintiff chose to proceed on his amended 22 complaint against defendants Turner-Gambery, Cheney, Mitchell and Swingle, effectively 23 choosing to terminate this action against defendant McDonald. 24 Accordingly, IT IS HEREBY RECOMMENDED that defendant McDonald be 25 dismissed from this action. 26 //// 1 Dockets.Justia.com 1 These findings and recommendations are submitted to the United States District 2 Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
