The thirty day period has now expired, and petitioner has not responded to the court’s 20 order and has not filed an application to proceed in forma pauperis or paid the filing fee. In accordance with the above, IT IS HEREBY ORDERED that the Clerk of the 21 22 Court is directed to randomly assign a district judge to this case; and IT IS HEREBY RECOMMENDED that this action be dismissed without 23 24 25 26 prejudice. These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
