On October 19, 2010, plaintiff’s consent to the jurisdiction of the Magistrate Judge was filed. 18 By order filed April 28, 2011, the undersigned ordered plaintiff to file either a 19 civil rights complaint or a petition for a writ of habeas corpus within thirty days from the service 20 of the court’s order. The thirty day period has now expired, and plaintiff has not filed a civil 21 rights complaint or a petition for writ of habeas corpus, nor has he otherwise responded to the 22 court’s order. 23 ///// 24 ///// 25 ///// 26 ///// 1 1 Accordingly, IT IS HEREBY ORDERED that this action is dismissed without 2 prejudice.
