O R D E R 13 COUNTY OF EL DORADO, et al., 14 Defendants. / 15 16 1. Plaintiffs’ motions to amend the First Amended Complaint, 17 and for appointment of a Guardian Ad Litem (Dkt. No. 48), shall 18 remain on the December 5, 2011 calendar with its current briefing 19 schedule; 20 2. The December 5, 2011 hearing on the cross-motions for 21 summary judgment (Dkt. Nos. 36 & 44), which motions are based upon 22 the above-referenced First Amended Complaint, is VACATED; 23 a. If the parties choose, they may renew their cross- 24 motions, or file replacement motions (including a renewed or 25 replacement motion for approval of the minors’ compromise), after 26 the court has ruled on the motions to amend and appoint a Guardian 1 1 Ad Litem (“GAL”). 2 b. Such renewed or replacement motions, if any, shall 3 be filed no later than two weeks after the court has ruled on the 4 motions to amend and for appointment of a GAL; 5 6 3. Plaintiffs’ “ex parte” application (Dkt. No. 33) to modify the scheduling order is denied as moot.1 7 IT IS SO ORDERED. 8 DATED: November 18, 2011. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 1 25 26 Plaintiffs asserted that they needed additional time to get a transcript for their summary judgment motion. They now have the time available to get the transcript for use in their renewed or replacement summary judgment motion. 2
