CIV.S-09-3364 FCD KJN ORDER AND ORDER TO SHOW CAUSE RE SANCTIONS defendants' pending motions to dismiss as moot based on plaintiff's filing of a First Amended Complaint on March 2, 2010 (Docket #13), said amended complaint was untimely filed. Civ. P. 15(a)(1)(B). Fed. R. Nonetheless, the court has accepted the filing and directs defendants to respond thereto as set forth in the Minute Order. 2.
