The warrant for the defendant currency was duly executed on August 24, 2012. 4. 25 Beginning on August 14, 2012, for at least 30 consecutive days, the United 26 States published notice of this action on the official government forfeiture site 27 www.forfeiture.gov. 28 /// 29 30 1 Final Judgment of Forfeiture 1 5. In addition to the public notice on the official internet government forfeiture 2 site www.forfeiture.gov, actual notice or attempted notice was given to the following 3 individuals: 4 a. Steven Jacob LaPointe aka Steven Jacob 5 b. Jacek W. Lentz, attorney 6 7 6. No parties have filed claims or answers in this matter, and the time in which any person or entity may file a claim and answer has expired. 8 Based on the above findings, and the files and records of the Court, it is hereby 9 ORDERED AND ADJUDGED: 10 11 12 13 14 1. The Court adopts the Stipulation for Final Judgment of Forfeiture entered into by and between the parties to this action. 2. That judgment is hereby entered against Steven Jacob LaPointe aka Steven Jacob and all other potential claimants. 3. Upon entry of a Final Judgment of Forfeiture herein, $23,208.25 of the 15 defendant approximately $25,090.00 in U.S. Currency, together with any interest that has 16 accrued on the entire $25,090.00, shall be forfeited to the United States pursuant to 21 17 U.S.C. § 881(a)(6), to be disposed of according to law. 18 4. Upon entry of a Final Judgment of Forfeiture herein, but no later than 45 days 19 thereafter, $1,881.75 of the defendant approximately $25,090.00 in U.S. Currency shall be 20 returned to Steven Jacob LaPointe aka Steven Jacob through his attorney Jacek W. Lentz, 21 Law Offices of Jacek W. Lentz, 1055 Wilshire Boulevard, Suite 1996, Los Angeles, 22 California 90017, telephone (213) 250-9200. 23 5. That the United States of America and its servants, agents, and employees and 24 all other public entities, their servants, agents, and employees, are released from any and 25 all liability arising out of or in any way connected with the seizure, arrest, or forfeiture of 26 the defendant currency. This is a full and final release applying to all unknown and 27 unanticipated injuries, and/or damages arising out of said seizure, arrest, or forfeiture, as 28 well as to those now known or disclosed. The parties waived the provisions of California 29 30 2 Final Judgment of Forfeiture 1 Civil Code § 1542. 6. 2 That pursuant to the stipulation of the parties, and the allegations set forth in 3 the Complaint filed on August 10, 2012, the Court finds that there was probable cause for 4 arrest and seizure of the defendant currency, and for the commencement and prosecution of 5 this forfeiture action, and a Certificate of Reasonable Cause pursuant to 28 U.S.C. § 2465 6 shall be entered accordingly. 7 7. All parties are to bear their own costs and attorney’s fees. 8 8. The U.S. District Court for the Eastern District of California, Hon. Lawrence 9 10 J. O’Neill, District Court Judge, shall retain jurisdiction to enforce the terms of this Final Judgment of Forfeiture. 11 CERTIFICATE OF REASONABLE CAUSE 12 Based upon the allegations set forth in the Complaint filed August 10, 2012, and the 13 Stipulation for Final Judgment of Forfeiture filed herein, the Court enters this Certificate 14 of Reasonable Cause pursuant to 28 U.S.C. § 2465, that there was reasonable cause for the 15 seizure or arrest of the defendant currency, and for the commencement and prosecution of 16 this forfeiture action.
