HAMILTON, 11 Petitioner, 12 vs. 13 BOARD OF PAROLE HEARING, et al., 14 1:10-cv-01972 OWW DLB (HC) ORDER GRANTING MOTION TO PROCEED IN FORMA PAUPERIS ON APPEAL and DIRECTING CLERK TO SERVE THE COURT OF APPEALS (DOCUMENT #25) Respondent. 15 ________________________________/ 16 Petitioner is a prisoner proceeding pro se with a petition for writ of habeas corpus 17 pursuant to 28 U.S.C. § 2254. 18 On May 3, 2011, judgment was entered denying the petition for writ of habeas corpus. 19 On June 1, 2011, petitioner filed a notice of appeal, a motion for certificate of appealability and an 20 application to proceed in forma pauperis. Examination of petitioner’s application to proceed in 21 forma pauperis reveals that petitioner is unable to afford the costs of an appeal. Accordingly, the 22 application to proceed in forma pauperis on appeal is GRANTED. See 28 U.S.C. § 1915.
