This Stipulation is entered into by and between Plaintiff MAX L. REINIG (“Plaintiff”)

and Defendants METRO XPRESS and DALE PARKER (“Defendants”) by and through their

counsels of record.

The parties hereby agree and stipulate that Plaintiff’s Complaint and the entire
23
action, is hereby dismissed in its entirety with prejudice, each party to bear their own attorney’s
24
fees and costs.

The parties, by the undersigned counsel for each party, agree that this Stipulation may be

signed by counsel, and that all counsel listed below have authorized the submission of this
