Defendant, Federal 17 Express Corporation, (“Defendant”) removed this action to this Court on October 29, 2009. 18 Plaintiff filed a Motion to Remand on November 24, 2009, arguing that the removal was 19 improper. 20 On February 16, 2010, the Magistrate Judge issued Findings and Recommendations that 21 the Motion to Remand be denied. The Findings and Recommendations were served on all parties 22 and contained notice that any objections were to be filed within fifteen (15) days. To date, no 23 objections have been filed. 24 In accordance with the provisions of 28 U.S.C. § 636 (b)(1)(c), this Court has conducted a 25 de novo review of the case.
