DISMISSAL COUNTS AS STRIKE PURSUANT TO 28 U.S.C. § 1915(G) 13 / 14 15 Plaintiff John Albert Richardson ("plaintiff") is a 16 California state prisoner proceeding pro se in this civil rights 17 action pursuant to 42 U.S.C. § 1983. 18 a United States Magistrate Judge pursuant to 28 U.S.C. § 19 636(b)(1)(B) and Local Rule 302. 20 The matter was referred to On October 22, 2010, the Magistrate Judge filed a Findings 21 and Recommendations herein which was served on plaintiff and 22 which contained notice to plaintiff that any objection to the 23 Findings and Recommendations was to be filed within thirty days. 24 Plaintiff did not file a timely Objection to the Findings and 25 Recommendations. 26 In accordance with the provisions of 28 U.S.C. § 636(b)(1), 27 this Court has conducted a de novo review of this case.
