The matter was 18 referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 19 72-302. 20 Plaintiff, formerly an inmate in the custody of the California Department of Corrections 21 and Rehabilitation at North Kern State Prison, brings this action pursuant to 42 U.S.C. § 1983 22 against correctional officials employed by the CDCR at North Kern State Prison. Plaintiff’s 23 complaint sets forth allegations that defendants denied his request for a housing accommodation. 24 The Prison Litigation Reform Act provides that “[i]n no event shall a prisoner bring a 25 civil action . . . under this section if the prisoner has, on 3 or more occasions, while incarcerated 26 or detained in a facility, brought an action or appeal in a court of the United States that was 27 dismissed on the ground that it is frivolous, malicious, or fails to state a claim upon which relief 28 may be granted, unless the prisoner is under imminent danger of serious injury.” 28 U.S.C. § Dockets.Justia.com 1 1915(g). 2 This plaintiff has, on 3 prior occasions, brought civil actions challenging the conditions of 3 his confinement. All three action were dismissed as frivolous, or for failure to state a claim upon 4 which relief can be granted. Brown v. The Findings and Recommendations issued by the Magistrate Judge on January 14, 20 21 22 23 2010, are adopted in full; and 2. Plaintiff’s application to proceed in forma pauperis is denied pursuant o 28 U.S.C. § 1915(g). 3. Plaintiff is directed to submit the $350 filing in full within thirty days of the date of 24 service of this order.
