Reference to these entities may be made by the parties to explain the chronology of the transactions but no reference can be made regarding the liability of these 17 defendants. 18 Motion 3: Motion to exclude reference to or testimony regarding settlement negotiations. (Doc. 184). 19 Ruling: Granted. 20 Motion 4: Motion to exclude comments about the financial condition of any of the Defendants. 21 (Doc. 185). 22 Ruling: Granted, except that financial information will be permitted to be presented if the jury determines that punitive damages are warranted. 23 Motion 5: Motion to exclude evidence or comment about Jay Bernstein's physical condition 24 (Doc. 186).1 25 26 27 28
It appears this motion is no longer relevant as Jay Bernstein has entered into a settlement agreement with P la in tiff in this matter.

Information about Jay Bernstein's medical condition may only be introduced as it relates to his inability to testify (i.e., if his medical conditions affect his speech). 2 Motion 6: Motion to exclude both expert and lay opinion evidence from Defendants and their 3 witnesses. (Doc. 187). 4 Ruling: Granted in Part. No experts will be allowed to testify since no experts were designated. Lay witnesses will be permitted to testify regarding lay opinions but will not be permitted to 5 provide expert testimony. 6 Motion 6: Motion to exclude evidence offered by defendants which were not identified in the joint pretrial statement/pretrial order.
