Plaintiff Thomas D. Braley (“Plaintiff”) is a state prisoner proceeding pro se and in forma
16
pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. On June 15, 2011, an order issued
17
adopting the findings and recommendations recommending dismissing Plaintiff’s motion for a court
18
order, motion for an order to show cause, and motion for a preliminary injunction. (ECF No. 53.)
19
Plaintiff filed a notice of appeal on July 18, 2011. (ECF No. 55.) On October 28, 2011, Plaintiff
20
filed a motion for a transcript of the hearing on his motions.
21
In this action, there have been no court hearings to date. Therefore, no transcripts exist at
22
this stage of the proceedings for the Court to produce in response to Plaintiff’s motion. Accordingly,
23
IT IS HEREBY ORDERED that Plaintiff’s motion for transcript of hearing, filed on October 28,
24
2011, is DENIED.
