TO THE COURT IN THE ABOVE-CAPTIONED ACTION:

On May 19, 2011, defense counsel and Plaintiff had a telephone conversation at which time
22
the parties agreed to request the Court to refer this case to the Prisoner Pro Se Mediation Program
23
in order to explore a possible settlement of this case. The parties also agree that should this case
24
be referred to the Pro Se Mediation Program and the mediation is unsuccessful, the parties will
25
maintain all their litigation rights, including taking the case to trial.

As such the parties jointly request that the case be referred to the Pro Se Mediation Program
