Plaintiffs shall take nothing in this action on their claims and causes of 7 action against Defendant R&K Hughes Family Partners LP and all claims 8 against it are hereby dismissed with prejudice, final judgment is entered in 9 favor of R&K Hughes Family Partners LP. 10 2. While Plaintiffs did not move for summary judgment on their first cause of 11 action for withdrawal liability, the only claim alleged against HOWS 12 Markets, LLC, the Court concludes that the elements of that claim are 13 established such that final judgment is entered in favor of Plaintiffs against 14 HOWS Markets, LLC on their claim for withdrawal liability. 15 16 IT IS SO ORDERED. 17 18 DATED: December 20, 2022 19 20 _________________________________________ HON.
