Defendant shall pay the total of disgorgement, prejudgment interest, and penalty du e of $199,660.34 to the Commission according to the following schedule: (1) $59,898.10 within 14 days of the entry of this Final Judgment; (2) $139,762.24 within 364 days of the entry of this Final Judgment plus post judgment interes t, which accrues pursuant to 28 U.S.C. § 1961 on any unpaid amounts due after 14 days of the entry of Final Judgment. A penny stock is any equity security that has a 20 price of less than five dollars, except as provided in Rule 3a51-1 under the 21 Exchange Act [17 C.F.R. 240.3a51-1]. 22 23 V. 24 IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that, pursuant 25 to Section 21(d)(2) of the Exchange Act [15 U.S.C. § 78u(d)(2)] and Section 20(e) 26 27 28 of the Securities Act [15 U.S.C. § 77t(e)], Defendant is prohibited, for five years following the date of entry of this Final Judgment, from acting as an officer or -4- 1 2 director of any issuer that has a class of securities registered pursuant to Section 12 of the Exchange Act [15 U.S.C. § 78l] or that is required to file reports pursuant to 3 4 5 6 Section 15(d) of the Exchange Act [15 U.S.C. § 78o(d)]. Defendant may also pay by 16 certified check, bank cashier’s check, or United States postal money order payable 17 to the Securities and Exchange Commission, which shall be delivered or mailed to 18 19 Enterprise Services Center 20 Accounts Receivable Branch 21 6500 South MacArthur Boulevard 22 23 Oklahoma City, OK 73169 24 and shall be accompanied by a letter identifying the case title, civil action number, 25 and name of this Court; Defendant’s as a defendant in this action; and specifying 26 27 that payment is made pursuant to this Final Judgment. 28 -6- 1 2 Defendant shall simultaneously transmit photocopies of evidence of payment and case identifying information to the Commission’s counsel in this action. By 3 making this payment, Defendant relinquishes all legal and equitable right, title, and 5 4 interest in such funds and no part of the funds shall be returned to Defendant. The 6 Commission shall send the funds paid pursuant to this Final Judgment to the United 7 States Treasury.
