This Court's Order dated October 27, 2008 denying Plaintiffs Motion for Summary Jud gment and granting Defendants Motion for Summary Judgment is attached hereto as Exhibit 1 and incorporated by this reference. Accordingly, the Court finds that there is no genuine issue as to any material fact, that Great-West is entitled to judgment as a matter of law, and that Plaintiffs Complaint has no merit. It is therefore ordered, adjudged and decreed as follows: (1) Plaintiffs Complaint herein is dismissed with prejudice; and (2) Great-West shall recover its costs of suit incurred herein.(MD JS-6, Case Terminated).
