Relief Defendants shall provide a cover letter to the Court identifying that Thomas Avery and T.M.A. Investment Enterprises are making the payment and relinquishing their rights to the froz en funds pursuant to this Final Judgment and that they are relief defendants in this action; and setting forth the title and civil action number of this action and the name of this Court. Relief Defendants shall simultaneously transmit photocopies of such payment and letter to the Commission's counsel in this action. By making this payment, Relief Defendants relinquish all legal and equitable right, title, and interest in such funds, and no part of the funds, or any interest earned on the f unds, shall be returned to Relief Defendants. These 10 funds, together with any interest and income earned thereon (collectively, the 11 “Fund”), shall be held in the interest bearing account until further order of the 12 13 Court. In accordance with 28 U.S.C. § 1914, LR 67-2, and the guidelines set by 14 the Director of the Administrative Office of the United States Courts, the Clerk is 15 16 directed, without further order of this Court, to deduct from the income earned on 17 the investment in the Fund a fee not to exceed the amount prescribed by the 18 Judicial Conference of the United States. The Commission may by motion 19 20 propose a plan to distribute the Fund subject to the Court’s approval. Defendant 21 shall pay post-judgment interest on any delinquent amounts pursuant to 28 USC 22 §1961. 23 24 25 26 II.
