Hatter, Jr for Report and Recommendation 12 : IT THEREFORE IS ORDERED that (1) plaintiff's claims against theLAPD defendants in their official capa cities are dismissed without leave to amend; (2) plaintiff's claims against Officers Sun and Swailes in their individual capacities are dismissed with leave to amend; and (3) if plaintiff still desires to pursue his claims against Detective Pueb la and Officers Sun and Swailes in their individual capacities, he shall file a Third Amended Complaint within thirty (30) days that is limited to his claims against those defendants in their individual capacities and that rectifies the deficiencies discussed in the Report and Recommendation.
