IT IS ORDERED, ADJUDGED, AND DECREED that defendant Avery 3 shall pay a civil penalty in the amount of $200,000 pursuant to Section 21(d)(3) of 4 the Securities Exchange Act of 1934, 15 U.S.C. § 78u(d)(3). Avery shall make this 5 payment within ten (10) business days after entry of this Final Judgment by 6 certified check, bank cashier’s check, or United States postal money order payable 7 to the Securities and Exchange Commission. The payment shall be delivered or 8 mailed to the Office of Financial Management, Securities and Exchange 9 Commission, Operations Center, 6432 General Green Way, Mail Stop 0-3, 10 Alexandria, Virginia 22312, and shall be accompanied by a letter identifying 11 Avery as a defendant in this action; setting forth the title and civil action number of 12 this action and the name of this Court; and specifying that payment is made 13 pursuant to this Final Judgment. Avery shall pay post-judgment interest on any 14 delinquent amounts pursuant to 28 U.S.C. § 1961.
