Service o f process was properly made against Defendants. 12 6. 13 14 Heeling owns o r controls the pertinent rights in and to the following p a t e n t s , a n d a l l o f t h e c l a i m s t h e r e o f , are v a l i d a n d e n f o r c e a b l e : U n i t e d S t a t e s P a t e n t No. 6 , 4 0 6 , 0 3 8 ( " t h e ' 0 3 8 P a t e n t " ) , U n i t e d S t a t e s P a t e n t No. 6 , 7 3 9 , 6 0 2 ( " t h e ' 6 0 2 15 Patent"), and United States Patent No. 6,746,026 ("the ' 0 2 6 Patent") (collectively 16 " t h e Patents"). 17 7. 18 D e f e n d a n t s a n d t h e i r a g e n t s p u r c h a s e d , used, a n d / o r s o l d w h e e l e d footwear that were the same as o r similar to those shown in Exhibit A (hereinafter 19 20 21 " K n o c k o f f S k a t e s " ) t o t h i s P e r m a n e n t I n j u n c t i o n a n d F i n a l J u d g m e n t , and s u c h a c t s directly infringed one o r more claims o f each o f the ' 0 3 8 Patent, the '602 Patent, and 22 23 24 t h e ' 0 2 6 P a t e n t . T h e K n o c k o f f S k a t e s are w h e e l e d f o o t w e a r h a v i n g o n e o r m o r e wheels in an opening in the bottom o f the heel that allow a user to walk o r run o n the forefoot and transition to rolling on the wheel o r wheels in the heel. 25 26 8. The Parties have resolved their dispute b y entering into a Settlement A g r e e m e n t b e t w e e n them ( h e r e i n a f t e r " S e t t l e m e n t A g r e e m e n t " ) , a n d h a v e a g r e e d that this Court shall retain exclusive jurisdiction over the Parties as to any disputes o r 27 f u r t h e r a c t i o n s r e g a r d i n g o r r e l a t i n g to t h e S e t t l e m e n t A g r e e m e n t , a n d to e n t e r t a i n 28 Heeling v. My Roller Shoes, et at.: [Proposed] Judgment -2_ such further proceedings and to enter such further orders as may be necessary or 2 appropriate to implement and enforce the provisions o f this Permanent Injunction 3 and Final Judgment. The Parties acknowledge, agree and willingly submit that they 4 are subject to personal jurisdiction o f this Court to handle all such disputes. 5 9. 6 7 Plaintiff has established a reasonable royalty under 35 U.S.C. § 284 o f Fifteen Dollars ($15.00) per pair o f Knockoff Skates. 10. 8 9 Defendants, their agents, employees, successors, heirs, and assigns, and all other persons and entities in active concert or participation with them who receive actual notice hereof by personal service or otherwise are enjoined and restrained 10 from infringing, either directly or indirectly, or inducing infringement o f or 11 contributorily infringing any o f the claims o f the '038 Patent, the '602 Patent, and 12 the ' 0 2 6 Patent, and from making, having made, importing, purchasing, using, 13 selling or offering to sell Knockoff Skates during the life o f such patents, including 14 any wheeled footwear or skate having at least one wheel in the heel that is to be or is 15 used by walking or running on the forefoot portion o f the sole and then transitioning 16 to rolling on the wheel or wheels in the heel. 17 11. 18 19 Nothing herein shall be construed as a release as to any third party, including, for example, the party(s) that manufactured the Knockoff Skates, the party(s) that supplied the Knockoff Skates to Defendants, the party(s) that purchased 20 the Knockoff Skates from Defendants, or others that may have participated in the 21 infringement by Defendants through acts constituting inducement o f patent 22 infringement o f any o f the '038 Patent, the '602 Patent, or the '026 Patent. 23 12. 24 Except as provided herein and in the Settlement Agreement, all claims alleged in this action by and against MRS, Tammy, and Li only are dismissed with 25 prejudice. 26 13. 27 28 This Permanent Injunction and Judgment shall be deemed to have been served upon Defendants at the time o f its execution by the Court.
