The Court will dismiss the Petition without prejudice. 20 I. Application to Proceed In Forma Pauperis 21 Petitioner’s Application to Proceed In Forma Pauperis indicates that his inmate trust 22 account balance is less than $25.00. Accordingly, the Application to Proceed In Forma 23 Pauperis will be granted. See LRCiv 3.5(b). 24 II. Petition 25 This is Petitioner’s third petition for a writ of habeas corpus challenging his 26 conviction in Maricopa County Superior Court, case #CR-2005-008016-001 DT, for 27 Burglary. On May 4, 2009, Petitioner filed his first petition for a writ of habeas corpus 28 Dockets.Justia.com 1 regarding that conviction, Johnson v. Ryan, 09-CV-959-PHX-GMS (DKD). In a May 5, 2 2010 Order (Doc. 17 in 09-CV-959-PHX-GMS (DKD)), the Court dismissed the habeas 3 petition, without prejudice, because Petitioner had a pending state-court petition for post- 4 conviction relief when he filed the habeas petition. The Clerk of Court entered Judgment 5 accordingly (Doc. 18 in 09-CV-959). 6 On May 13, 2010, Petitioner filed his second petition for a writ of habeas corpus 7 regarding the same state-court conviction, Johnson v. Ryan, 10-CV-1052-PHX-GMS (DKD). 8 In a January 25, 2011 Order (Doc. 11 in 10-CV-1052-PHX-GMS (DKD)), the Court denied 9 the petition, and the Clerk of Court entered Judgment accordingly (Doc. 12 in 10-CV-1052). 10 Petitioner appealed (Doc. 13 in 10-CV-1052), but the Ninth Circuit Court of Appeals 11 declined to issue a certificate of appealability (Doc. 16 in 10-CV-1052). 12 Under 28 U.S.C. § 2244, a petitioner may not file a second or successive § 2254 13 petition in the district court unless the petitioner has obtained a certification from the Ninth 14 Circuit Court of Appeals authorizing the district court to consider the second or subsequent 15 § 2254 petition. A habeas petition is “‘second or successive’ if it raises claims that were or 16 could have been adjudicated on their merits in an earlier petition.” Cooper v. Calderon, 274 17 F.3d 1270, 1273 (9th Cir. 2001) (per curiam). The current petition, therefore, is a second or 18 successive petition. 19 Petitioner has not presented a certification from the Ninth Circuit authorizing the 20 Court to consider a second or subsequent § 2254 petition. Accordingly, the current Petition 21 and this action must be dismissed as a successive petition. The Court, however, will dismiss 22 the case without prejudice so that Petitioner can seek certification from the Ninth Circuit to 23 file a second or successive § 2254 petition. 24 Accordingly, 25 IT IS ORDERED: 26 (1) Petitioner’s Application to Proceed In Forma Pauperis (Doc. 2) is granted. 27 28 -2- 1 2 3 (2) Petitioner’s Petition for Writ of Habeas Corpus (Doc. 1) and this action are dismissed without prejudice, and the Clerk of Court must enter judgment accordingly.
