See Doc. 32. No objections were filed and the deadline has passed. After due and proper consideration of all portions of this file deemed relevant to the issues raised, and there having been no objections filed, the Recommendation of the Magistrate Judge is ADOPTED as the opinion of this Court. It is ORDERED that the motion for partial dismissal filed by Defendant Boost Carriers is GRANTED. Any claim in Count II of Plaintiff’s Amended Complaint for respondeat superior liability based on more than negligence is DISMISSED without prejudice.
