Melvin Surgeon, Petitioner Appellant, v. Charles Hill, Respondent Appellee, 30 F.3d 131 (4th Cir. 1994)

Annotate this Case
U.S. Court of Appeals for the Fourth Circuit - 30 F.3d 131 (4th Cir. 1994) Submitted: May 17, 1994. Decided: July 14, 1994

Appeal from the United States District Court for the Eastern District of North Carolina, at Raleigh. James C. Fox, Chief District Judge. (CA-93-114-HC)

Melvin Surgeon, Appellant Pro Se.

Clarence Joe DelForge, III, Office of the Attorney General of North Carolina, Raleigh, North Carolina, for Appellee.

E.D.N.C.

DISMISSED.

Before PHILLIPS and WILKINS, Circuit Judges, and SPROUSE, Senior Circuit Judge.

PER CURIAM:

Appellant seeks to appeal the district court's order denying relief on his 28 U.S.C. § 2254 (1988) petition. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court that Appellant's claims were procedurally defaulted.*  Surgeon v. Hill, No. CA-93-114-HC (E.D.N.C. July 7, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED

We have considered Appellant's claim of ineffective assistance of counsel on the merits and find that he was not prejudiced. See Strickland v. Washington, 466 U.S. 668 (1984)
