Annotate this Case
US Court of Appeals for the Ninth Circuit - 927 F.2d 609 (9th Cir. 1991)

No. 90-35530.

United States Court of Appeals, Ninth Circuit.

Appeal from the United States District Court for the District of Idaho, No. CV-89-1251; Harold L. Ryan, District Judge, Presiding.

AFFIRMED

Before WALLACE, Chief Judge, O'SCANNLAIN, Circuit Judge, and BURNS,*  District Judge.

ORDER

Hubbard appeals from a summary judgment entered by the district court. The issue before us is whether the district court was correct in ruling that the Howards were entitled to immunity under Idaho Code Sec. 25-2118, because the highway on which the accident occurred was within an open range. For the reasons stated by the district court, we affirm.

The request by the Howards for attorneys' fees is denied.

Note: This disposition is not appropriate for publication and may not be cited to or by the Courts of this Circuit except as provided by Ninth Circuit Rule 36-3.

Honorable James M. Burns, United States District Judge, District of Oregon, sitting by designation
