Annotate this Case
US Court of Appeals for the Fourth Circuit - 904 F.2d 702 (4th Cir. 1990) Submitted: Jan. 30, 1990. Decided: May 24, 1990. Rehearing and Rehearing In Banc Denied June 30, 1990

Appeal from the United States District Court for the Eastern District of Virginia, at Norfolk. J. Calvitt Clarke, Jr., District Judge. (C/A No. 88-609-N).

Ronald Charles Wagener, appellant pro se.

Richard Bain Smith, Assistant Attorney General, Richmond, Va., for appellee.

E.D. Va.

DISMISSED.

Before DONALD RUSSELL, WIDENER and CHAPMAN, Circuit Judges.

PER CURIAM:

Ronald Charles Wagener seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Wagener v. Murray, C/A No. 88-609-N (E.D. Va. May 10, 1989). The motion for release on bail pending appeal is denied as moot. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED
