Richard E. Smyer, Jr. appeals from the district court's order denying relief under 42 U.S.C. § 1983. Our review of the record and the district court's opinion discloses that this appeal is without merit. Private attorneys are not amenable to suit under Sec. 1983 whether privately retained, Deas v. Potts, 547 F.2d 800 (4th Cir. 1976) or court-appointed, Hall v. Quillen, 631 F.2d 1154 (4th Cir. 1980), cert. denied, 454 U.S. 1151 (1982). We dispense with oral argument because the dispositive issues recently have been decided authoritatively.

AFFIRMED.
