Annotate this Case
US Court of Appeals for the Fourth Circuit - 872 F.2d 418 (4th Cir. 1989) Submitted Dec. 9, 1988. Decided March 24, 1989

Joseph P. Payne, Sr., appellant pro se.

Richard Francis Gorman, III, Office of the Attorney General of Virginia, for appellees.

Before WIDENER, SPROUSE, and WILKINS, Circuit Judges.

PER CURIAM:

Joseph P. Payne, Sr., appeals from the district court's order denying relief under 42 U.S.C. § 1983. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Payne v. Bair, C/A No. 87-41-AM (E.D. Va. May 3, 1988). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
