Charles T. James, Petitioner-appellant, v. John Brown, Warden, Respondent-appellee, 865 F.2d 1258 (4th Cir. 1989)

Annotate this Case
US Court of Appeals for the Fourth Circuit - 865 F.2d 1258 (4th Cir. 1989) Submitted: Oct. 25, 1988. Decided: Jan. 3, 1989

Charles T. James, Appellant pro se.

John Joseph Curran, Jr., Attorney General, Ann N. Bosse (Office of the Attorney General), for appellee.

Before JAMES DICKSON PHILLIPS, ERVIN and WILKINS, Circuit Judges.

PER CURIAM:

Charles T. James seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny James's motion for a certificate of probable cause to appeal and appointment of counsel, and dismiss the appeal on the reasoning of the district court. James v. Brown, C/A No. 88-1058-JFM (D. Md. July 25, 1988). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED.
