From and after December 31, 1978, or from and after the termination of any extension period granted by the department pursuant to section 5-108.03, whichever time is later, no permittee or affiliate thereof shall borrow from or accept loans or guarantees of loans from any licensed food and beverage concessionaire or any affiliate thereof, or make payments pursuant to any such loans, except that a permittee may accept loans or guarantees of loans, and may make payments pursuant to such loans, from a food and beverage concessionaire which is an affiliate of such permittee.
