A. The greenfields program fund is established for the purpose of implementing and administering the greenfields pilot program and shall consist of legislative appropriations and fees collected pursuant to section 49-154, subsection G. The director of the department of environmental quality shall administer the fund. Monies in the fund are continuously appropriated and are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.

B. The department of environmental quality shall finance the greenfields pilot program through the collection of fees established pursuant to section 49-154, subsection G, and shall repay annually to the state general fund monies remaining from fees received pursuant to section 49-154 which are not necessary for the administration of the greenfields pilot program.
